Ozet
Mevduata uygulanan zamanasimi kurallari, zamanasimina iliskin surenin baslama ani, surenin sona ermesinden sonra borclu tarafa yuklenen hak sahibini iadeli taahhutlu mektupla uyarma ve zamanasimina ugrayan mevduat hesaplarinin bir liste halinde ilani gibi yukumlulukleri icinde barindiran ozel bir zamanasimi gorunumundedir. Bu hususlarin yani sira; zamanasiminin ispati ve genel zamanasiminin aksine zamanasimina ugrayan borcun tabii borca donuserek borcluda kalmasi gibi hususlarda genel zamanasimi kurallarindan ayrildigindan, mevduat zamanasiminin teknik anlamda bir zamanasimi niteliginde olmadigini ifade etmek mumkundur.
Calismanin ilk bolumunde, mevduatin tanimi ve mevduat sozlesmesinin taraflari, kapsami ve hukuki niteligi degerlendirildikten sonra, ikinci bolumde mevduat zamanasimi ile genel zamanasimi kurallari karsilastirilip, mevduat zamanasimina iliskin kurallar, Yargitay’ in da ictihatlarina yer vermek suretiyle ayrintilariyla ele alinmistir.
Abstract
The rules of negative prescription of deposit money on banks are a kind of special prescription which includes obligations such as the start date of prescription, warning the holder of ownership with registered letter and publicly announcement the list of deposit accounts that are statute-barred. In addition to those matters, it is possible to claim that negative prescription about deposit money technically can not be regarded as prescription because it differs from rules of general prescription in many aspects such as the proof of time of prescription and as opposed the general prescription, the change of the debt barred by the statute of limitations to natural obligation and its stay on debtor.
The definition of bank deposit contracting parties, the extent and legal characteristics are explained in the first part of the study. The rules of prescription of deposit money and general prescription are compared in second part. Then, detailed explanation of the rules of prescription of deposit money are tackled in detail with judicial opinion of Supreme Court.
