La Constitución española de 1837 ha sido vista tradicionalmente como
transaccional. Los historiadores han señalado que el progresismo traicionó sus principios
doceañistas para pactar con el moderantismo. En el presente texto sostengo que pudo
no ser así, que fue una obra netamente progresista. Para ello argumento que no pudo
haber pacto porque los moderados eran vistos como traidores a la Nación y la Libertad
por unos progresistas triunfantes de la revolución de julio-agosto de 1836, que el texto
constitucional recogió los principios progresistas ?soberanía nacional, senado electivo,
Milicia Nacional, ayuntamientos nombrados por los vecinos? que fueron fruto de los
debates de las dos grandes corrientes que forjan el progresismo ?la avanzada y la
templada?, y por último porque los moderados revirtieron esta obra legislativa en cuanto
tomaron el poder en 1845, aunque previamente ya lo habían intentado entre 1838 y 1840
The Spanish Constitution of 1837 has traditionally been seen as a transactional
constitution. Historians have pointed out that the Progressives betrayed the principles of
the Constitution of 1812 in order to compromise with the Moderates. However, in this
article I maintain the opposite claim: that the Constitution of 1837 was, in fact, entirely
progressive. The arguments I put forward to support this assertion are the following:
firstly, such a pact could not have been made, because the Progressives –who had emerged
victorious from the Revolution of July and August 1836– saw the Moderates as traitors to
the principles of Nation and Freedom; secondly, the contents of the Constitution included
the progressive principles –National Sovereignty, an elected senate, a National Guard,
elected councils– that had their origins in the debates between the radical faction and the more restrained faction of Progressivism; and, lastly, this Constitution was replaced by the Moderates as soon as they took over the government in 1845.
