The problem of ijtikhad always has always been particularly acute in the history of the Islamic law. Thanks to the processes of the ethno-confessional revival which began in the late eighties, this problem gained more popularity for the Russian researchers. The earliest stage of development of ijtikhad which is inseparably linked with the prophet Muhammad and his associates is considered in this reseach. Two basic la schools of Islam: madrasat ar-ra’y and madrasat al-hadith appeared during this stage. The author of the article comes to conclusion that the work of theologians of that period was doing “ifta” (the process of making theologian conclusions) and rendering of prophet Muhammad's hadithes to his associates. The theological scool madsarat al-hadith and madsarat ar-ra’y gained strength. At the same time no documents about of their activity wese written, and no sources were found related to that period.
